We also provide patentability, freedom to operate, and validity opinions, and advise in disputes before patent offices concerning ownership and inventorship.

Our team works with clients to understand their businesses and to help them implement cost-effective trademark protection and enforcement strategies, in Canada and around the world. We help our clients understand the nuances of Canadian trademark law, including current precedent-setting case law and the impact of future legislative changes.

Our clients range from multinational Fortune 500 companies with global trademark portfolios to agile and resourceful start-ups launching their first product and brand. Our advice is practical, commercial, and strategic, and based on decades of experience gained in the field. Our services include providing searches and registrability opinions; preparing, filing and prosecuting applications; managing worldwide portfolios; advocating in the Trademarks Opposition Board and in Court; drafting and negotiating licenses and providing transactional support such as due diligence reviews and trademark portfolio audits. We also provide advice and advocacy in domain name disputes, Internet issues, anti-counterfeiting matters and marketing and advertising issues.

We advise clients on all aspects of copyright law in the traditional and digital realms, and help them understand their rights and obligations in the age of social media, crowdsourcing, open source licensing, and user-generated content. We provide practical and relevant advice on licenses, moral rights, and use of third-party works. We also help clients secure design registration for their iconic product designs, and design strategies combining design protection with patent and other forms of intellectual property.

Enforcement

Enforcement

We help clients acquire intellectual property rights; we also help them enforce those rights and defend against infringement proceedings before the Trademark Opposition Board and the Ontario and Federal Courts. Henry Lue has been counsel on precedent-setting Supreme Court cases involving fundamental trademark issues, including cases defining the law on trademark functionality. He has acted for clients with significant investments in brands covering the gamut from luxury cars to financial services.

In disputes and in negotiation, we create leverage, and develop and execute effective strategies to arrive at the best possible outcome for our clients.

As part of our intellectual property services, we assist clients in assessing and mitigating intellectual property risk. We provide validity and infringement opinions for patents, trademarks, designs, and copyright; provide intellectual property clearance opinions regarding freedom to market new products; and advise on options for avoiding infringement altogether.

We also assist clients in removing obstacles from their business plans through patent re-examinations and trademark expungement proceedings.

We assist clients in contractual matters concerning all forms of intellectual property—patents, trademarks, copyright, and designs and all forms of contracts, including licensing agreements, franchise agreements, website and terms of use, beta testing, technology transfer, and open source licenses. We also provide support for transactional matters by providing due diligence reviews of intellectual property portfolios.

We help our clients preserve their competitive edge by providing advice and representation on trade secrets and confidential information. We draft, review, and negotiate ownership and non-disclosure agreements for employers, employees, contractors, and consultants, and assist in disputes on matters concerning breach of confidence.
